How can I transfer a Mark Record if I have an SMD file?

By executing the following steps you will be able to transfer a Mark Record to a Trademark Agent:

  • For the Trademark Holder or Trademark Agent that wishes to transfer their Mark Record:
  • Download the SMD file linked to the Mark Record;
  • Navigate to the TMCH portal: https://secure.trademark-clearinghouse.com/tmch/public/;
  • Click on the link to start the Mark Transfer process (last paragraph of the welcome text);
  • Upload your SMD file;
  • An e-mail will be sent to the e-mail address linked to the SMD file with a "Transfer Code";
  • Provide this "Transfer Code" to the Trademark Agent of your choice.
  • For the Trademark Agent that you provided with your "transfer code":
  • Sign in to the TMCH web interface;
  • Click on "Execute a Transfer";
  • Enter the "Transfer Code" you received from the previous Trademark Holder or Trademark Agent;
  • Your account will be charged for $30 and the Mark Record will be transferred to your account.
